When you use any of our products and/ or services, the Privacy Policy will apply whether separate privacy terms are set for the products and/ or services you use and whether you are a browsing user (visitor) or a login user.Nevertheless, the Privacy Policy does not apply in the following circumstances:

Our products and/ or services may contain or be linked to information and/ or services of a third party (including any third party application, website, product and service). Such third party is responsible for operating such information and/ or services. We are not liable for your use of such information and/ or services. The Privacy Policy merely applies to your personal data collected by us. It neither applies to any third party’s collection of your personal data nor third party’s rules for provision of services or data use. To the extent permitted by law, we are not responsible for collection, storage or use of your personal data by anythird party.

II.How do we collect and use your personal data?

(I) Purposes of data collection

We will only process your personal data to the extent necessary to fulfill the purposes. The purpose of our collection of personal data is to provide you with products and/or services, and to ensure the compliance with applicable laws, regulations and other regulatory requirements. Regarding the purpose for which your personal data is collected, more detailed explanations are given in specific function scenarios as follows.

(II) Types of collected data

During your use of our products and/or services, we do or may need collecting and using your personal data of the following two types:

Type 1: data necessary for basic functions of our products and/ services. Such data is prerequisite for proper functioning of our products and/ services and you must authorize us to collect and use them.If you refuse to provide them, you will no longer use our products and/ services normally.

Type 2: data necessary for optional functions of our products and/ services. Such data is not prerequisite for proper functioning of our products and/ services and you may authorize us to collect and use them or not at your choice.If you refuse to provide them, such optional functions will not work normally or achieve the intended effect, or will become unavailable. However, there is no influence on the normal use of basic functions.

Here are specific function scenarios, including:

1.Account creation

In order to create an account to identify and store your personal data, deliver you reports related to your use of our products and/or services, and contact you or send necessary notices, we need to collect and use your cell phone number and unique ID information corresponding to your identity (unique ID information is automatically generated).If you refuse to provide it, we will not be able to identify the user nor provide the corresponding products and/or services or send notices. If you choose to create your account with password, we will also collect and store (encrypt) your password. In order to provide home page services and improve your home page information, we need to collect and use the profile picture and nickname information you provide to us.If you refuse to provide it, it may not achieve the intended effect. However, you can still use such service.

In addition, in order to provide better services, we need to process the operation record information related to the use of your application (e.g. authorization record, product connection and use record, remote control key record, APP function trigger record, etc.).If you refuse to provide, you will not be able to use our products and/or services.

2.Sleep log

To provide you with the sleep log service, we need to collect the data of your pre-sleep activities, physical conditions (required) and sleep quality (required).If you refuse to provide the information on sleep quality, our sleep log will be unavailable. If you refuse to provide the information on pre-sleep activities and physical conditions, the sleep log service may not achieve the intended effect. However, you can still use such service.

3.Sensor-based services

(1) Daily/ monthly/ Nap/ InitialAssessment/ Singlesleep quality report

To provide you with the Daily/ monthly/ Nap/ InitialAssessment/ Singlesleep quality report, we need to collect and use the dataof your sleep conditions (e.g. Sleep Score, Sleep Onset Time, Wake-up Time, Deep-sleep Duration, Light-sleep Duration and awake Duration collectively referred as sleep onset latency, Sleep Efficiency, Turns during Sleep, Time Out of Bed, Number Out of Bed, etc.),of your heart rate (e.g. Heart Rate during Sleep, Average Heart Rate, Heart Rate Reference Value ,Heart Rate Abnormality Index, Fatigue Index, Recovery Index, etc.),of your breath (e.g. Breathing Rate during Sleep, Respiratory Rate Reference Value ,Average Breathing Rate, etc.),of your snoring (e.g. Snoring Frequency, Intervention Count, Intervention Activation Time, Snoring Intervention Sensitivity, etc.) ,of your heart rate variability (e.g. SDNN, RMSSD, pNN50, LF/HF, etc.)and of yourAlgorithm information (e.g. apnea number, apnea occurrence time, apnea reference value, etc.) and generate your sleep quality report based on such data (refer to the Daily/ monthly/Nap/InitialAssessment/Singlesleep quality report for specific data we collect and use).You can turn on or off the data uploading with the data switch on My-Sleep Privacy of APP on your own decision. If you turn off the data switch, sleep quality reports will not be generated any longer and we will not process the above data. The snoring data will only be processed when you enable the function Snoring Intervention. Should you disable it, we will not process such data. You can find the relevant switch on My-Snoring Intervention of APP.

(2) Biological age

To provide you with the biological age service, we need to collect the data of your sex and date of birth and you must turn on the data switch. Based on the foregoing, we work out your Biological Age, Health Balance Index, Heart Rate, Respiration Rate, Autonomic Nervous System Balance Index, Parasympathetic Nervous System Activity Index, Parasympathetic Nervous System Tone Index and Heart Rate Variability Intensity Index, and generate your biological age report. If you refuse to turn on the data switch, our biological age service will be unavailable.If you refuse to provide the data of your sex and date of birth, the biological age service may not achieve the intended effect. However, you can still use such service.

(3) Other services

To provide you with optional sensor-based services better, we need to collect and use the data of your sex, date of birth, height and weight.If you refuse to provide the data of your weight, you will not use our products and/ or services. If you refuse to provide the data of your sex, date of birth and height, such optional services may not achieve the intended effect. However, basic functions still function.

4.Alarm call

To provide you with the alarm call service, we need to process the data of your clock setting, alarm time and alarm cycle. You turn on or off the alarm call with the clock switch onMy-Flexible Wake-up of APP on your own decision.If you turn it off, you will no longer use our alarm call service.

5.Cloud care service

In order to provide you with cloud care services, we need to process your ID, user ID, user nickname, user nickname, care information (sleep daily/monthly report information of the loved one (specific information is subject to the information displayed on the cloud care service page), care type and other information. We need to process the aforementioned personal information of the loved user, and you should ensure that you have legally obtained the consent of the loved user.If you take the initiative to choose Cloud care services, it means that you have obtained the consent of the cared user and agree that we process the above personal information of the cared user in accordance with the purposes and methods described in this Privacy Policy. If you refuse to provide, you will not be able to use our Cloud Care service.

6. Self-diagnostics in case of remote control failure

To help you identify and resolve problems quickly in case of control failure of your smart bed, we list possible causes and remedies onRemote Control-Can’t control of APP (upper right corner) for your reference and operation. To provide such service, we need to collect and use the pairing WiFi name. So, the self-diagnostics will run to check if such control failure of your smart bed is the result of inconsistent WiFi and you can resolve it quickly and independently.If you do not authorize us to acquire such data, it may compromise the self-diagnostics performance. Nevertheless, you can still contact us for solutions through our customer service or by the means stated Section VIII, Contact Us of the Privacy Policy. You can also cancel your authorization in the same way.

7.System privilege-based services

To collect and use your personal data in provision of the following products and/ or services, we need to enable certain system privileges.If you refuse to enable such privileges, you will not use our products and/ or services normally.

You can check the status of such privileges under Setting of your phone and enable or disable them at any time on your own decision.

It is noted that enabling of any privilege indicates that you authorize us to collect and use the relevant personal data to provide the corresponding services, and that disabling indicates that you cancel such authorization. Then we will no longer collect and use such personal data based upon the disabled privilege or provide the corresponding services. However, your disabling decision will not affect the data collection and use according to the prior authorization.

We will request the application permissions and access the applications as follows:

1.Camera: To link your account with our product, you need to enable your camera to scan relevant QRs.If you refuse to enable it, you will not use our products and services.

In addition, if you turn on the camera/camera permission, you can take photos to improve your personal homepage information.If you do not turn on the permission, it will not affect the use of the basic functions of the product, but may cause the service to fail to achieve the effect we intend to achieve.

2.Network: You need the data communication via network during the use of any of our products and/ or services.If you refuse to enable it, you will not use our products and services.

3.Location: To associate with our product, you need to enable the access to your location.If you refuse to enable it, you will not use our products and services.

4.Photo album: To associate with our product, you need to enable the access to your photo album.If you refuse to enable it, you will not use our products and services.

In addition, if you open the permission of the album, you can upload photos to improve your personal home page information.If you do not open the permission, it will not affect the use of the basic functions of the product, but may lead to the service can not achieve the effect we intend to achieve.

After enabling the access to your photo album, you may send your photos, pictures or videos during the use of our customer service to help our customer service provide the additional services.However, our customer service will still be available if you do not enable such access.

5.Bluetooth permission: in order to bind your account to our smart bed, you need to turn on Bluetooth.If you do not turn on this permission, you will not be able to use our products and services.

6.Memory (only for Android): You need to enable our access to your memory so that we can access your firmware to upgrade your smart bed.If not, your smart bed will not be upgraded. Nevertheless, you may not enable such access if you do not need or select such upgrading. In case that we suggest upgrading but you refuse it, it may influence your use of our products and/ or services.

In addition, if you need to access photos, media content, or files on your device, you need to enable storage rights.If you do not enable this permission, it will not affect the use of the basic functions of the product, but it may cause the service to fail to achieve the effect we intend to achieve.

You are kindly reminded to attach importance to the alerts we push about changes in your data. We may suggest you to take certain actions based on our measured data. You will make decisions on whether or not to follow our suggestions at your own discretion and bear all the consequences.

It is known that our products/ services are neither medical devices nor medical service. Our alerts about changes in your data are just for your reference rather than the basis of diagnosis and treatment.

It is particularly noted that we supply various products and services and the basic and optionalfunctions of our products and/or services (including the type and scope of your personal data we collect) vary with the specifications of our products/services. So, your usage is subject to the product/ service you receive. In addition, it is understood and agreed that we will continue to improve our products and services, including technology, in hope of offering perfect products and services. It means that we may from time to time adopt new functions that may require the collection of additional personal data or change in the purpose or usage of your personal data. If a function or product/service requiring the collection of your personal data is not described herein, we will separately state the purpose, content, use and scope of such data collection by updating the Privacy Policy, page prompts, pop-up messages and other ways, and allow you to choose giving consent to such data collection at your own decision. We will not collect such data until you give us the consent expressly. It is also understood fully that, subject to provisions of laws, we will process your personal data without your authorization or consent if:

1.With respect to the your vital interests, it is necessary to respond to any public health emergency or protect the health, life and property of yours or your relatives or friends;

2.With respect to matters influencing the public, it is necessary to process your personal data that you have disclosed on your own or otherwise lawfully disclosed to a reasonable extent, fulfill the legal duties or obligations for the state interests, or for news release in the public interest;

3.With respect to legal interests, it is necessary for our necessary evaluation, investigation, litigation, recovery of debts and other legal interests;

4.With respect to the trading of businesses and assets, it is necessary to execute and perform commercial contracts for trading of our business and assets; and/or

5.With respect to the business improvement, it is necessary to sign with existing or potential customers contracts for improving or developing our products and/ or services.

We promise not to give, sell, rent, share or trade your personal data to any unrelated third party unless we obtain your prior permission.

We also do not allow any unauthorized third party to collect, edit, sell or distribute for free your personal data by any means. If it is found that any user of our products engages in any of these activities, we reserve the right to immediately terminate the cooperation with such user.

III. How do we share, transfer, and publicly disclose your personal data?

(I) Sharing

Your personal data is an essential basis and an integral part in provision of our products and/or services. We will only process your personal data for the purposes and to the extent stated in the Privacy Policy or as provided in laws and regulations and keep them strictly confidential. Subject to the laws of the Republic of Singapore or for administrative purposes and to the extent permitted and/or required by local laws, we may need to share your personal data with governmental agencies, law enforcement officers or supervisory authorities under following conditions:

(III) Transfer

If your personal data has to be transferred due to our merger, split, dissolution, declared bankruptcy or others, we will inform you of the recipient’s name and contact information. Such recipient will continue to fulfill the Privacy Policy and other legal obligations and change the original purposes or the method of processing, whenever applicable, with your consent.

(IV) Public disclosure

Public disclosure refers to the disclosure of data to the public or the unspecified group of people. We will only publicly disclose your personal data if:

You have following rights over your personal data processed in our products and/ or provision of our services. To help you exercise these rights, we provide you with operation guides and settings on relevant function pages in our APP. You may exercise any of your rights independently. If you have any doubt or difficulty in exercising your rights, please contact us by means stated in the Section VIII, Contact Us of the Privacy Policy and request us to control the operation. We will deal with your request in a timely manner in compliance with laws and regulations.

(I) Inquiry, correction and supplementation

You can exercise your right to inquire, correct and supplement your personal data by any of two means:

1.Active online inquiry, correction and supplementation. We provide you with operation guides and settings on relevant function pages in our APP so that you can inquire, correct and supplement a part of your personal data directly.

2.Contact us by means stated in the Section VIII, Contact Us of the Privacy Policy. With respect to a part of your personal data that you cannot inquire, correct and supplement directly, please Contact us by means stated in the Section VIII, Contact Us of the Privacy Policy and request us to conduct such inquiry, correction and supplementation. In this case, we need to verify your identity. Please provide sufficient information to enable us to verify your identity.

(II) Clearing

Generally we will keep your personal data for the shortest yet necessary time as provided in laws and regulations. Unless your personal data has been made anonymous or otherwise specified in laws and regulations, you can Contact us by means stated in the Section VIII, Contact Us of the Privacy Policy and request us to clear your personal data under the following circumstances:

(1) We process your personal data in violation of the provisions of laws and regulations.

(2) We process your personal data without your express consent.

(3) We process your personal data in serious breach of the agreement with you.

(4) Our purposes to process your personal data have been achieved, cannot be achieved or become unnecessary;

(5) We stop providing products and/ or services, or the data retention period has expired.

If we decide to respond to your request for deletion, we will try to inform other subjects, if any, receiving your personal data from us at the same time, and request them to clear such data promptly (unless otherwise provided in laws and regulations, or they have obtained your consent separately).

It is understood and agreed: we may not be able to immediately remove your personal data from the backup system due to applicable legal and security technologies after you clear your personal data in our products and/ or services. If this is the case, we will securely store your personal data and isolate it from any further processing until the backup can be cleared or be made anonymous.

(III) Request

If you need the copy of your personal data, please contact us by means stated in the Section VIII, Contact Us of the Privacy Policy. After verifying your identity, we will provide such copy of your personal data we collect in our services unless otherwise provided in laws, regulations or the Privacy Policy.

(IV) Withdrawal of consent

Should you intend to change the scope of authority relating to certain functions, you can modify your personal settings directly via your phone or on the related setting interfaces contained in our products and/or services. Alternatively, you can contact us by means stated in the Section VIII, Contact Us of the Privacy Policy to withdraw all authorizations upon us to continue collecting your personal data.

We will no longer collectyour personaldata and you will not receive corresponding services from us when you withdraw the authorization relating to collection of personal data. However, you recognize and agree that the withdrawal of your consent or authorization will not affect the validity of our processing of your personal data on the basis of the prior consent you give to us.

(V) Cancellation

You have the right to cancel your account on My- Setting of your APP. Alternatively, you may contact us by means stated in the Section VIII, Contact Us of the Privacy Policy and request us to cancel your account (unless otherwise provided in laws or specified in the Privacy Policy). You will be prevented from using the full range of our products and services after you cancel your account. Please cancel your account prudently. After you cancel your account, we will no longer provide to you all our products and services and all your information, data and records of your use of our products and services with such account will be cleared or made anonymous unless otherwise provided in applicable laws and regulations.

(VI) Prior notice about discontinuation of products and/ or services

We will continue to provide you with high quality services. If we have to discontinue some or all of our products and/or services for special reasons, we will notify you in advance at a prominent position, by pushing a message or in other ways. In this case, we will stop processing your personal data, and your personal data in our control will be cleared or made anonymous after the shortest yet necessary data retention period as provided in laws and regulations.

V.How do we store and protect your personal data?

1.Place. We will store your personal data in a server in the territory of the Republic of Singapore as provided in laws and regulations.

2.Period. We will keep your personal data for the shortest yet necessary for the purpose of providing our products and services. Your personal data will be cleared or made anonymous after such retention period unless otherwise provided in laws and regulations.

(II) Protection of personal data

We have always attached great importance to protecting the personal data security of users. To minimize the risk of data leakage, destruction, misuse, unauthorized access, unauthorized disclosure and alteration, we have adopted security technologies and supporting organizational structure, management system and other multi-level protection measures in compliance with industry standards, including:

(1) With respect to the data transmission security, we apply the Transport Layer Security protocol and other encryption technologies to prevent our transmission link from sniffing, eavesdropping and intercepting in the various ways such as Https to create a secure environment for transmission of privacy data and guarantee the privacy and integrity of data transmission.

(2) With respect to the data storage security, we classify the data and adopt the encrypted storage and other additional security measures.

(3) With respect to the data access security, we implement a strict control mechanism for data access to prevent any unauthorized reading, reproduction, alteration, clearing or transfer of data.

(4) We have a comprehensive audit mechanism in place to supervise and audit the whole data lifecycle and protect your personal data against unauthorized access, public disclosure, use, alteration, intended or accidental loss or corruption.

We will inform you of relevant conditions in a form such email, letter, telephone call or pushing messages. If it is hard to notify all subjects of your personal data, we will make announcement in a reasonable and effective manner. Meanwhile, we will report to the supervisory authorities the handling of personal data security incidents as required.

Hence, we can take countermeasures to protect the privacy of your personal data.

VI. Protection of minors

During the transactions with you, we presume that you are sixteen years or elder. If we find that we collect the personal data from a minor, we will take appropriate protective measures. If you are a minor or a minor’s custodian and have any doubts about the personal data of the minor we collect, please contact our employee in charge of personal data protection by the means stated Section VIII, Contact Us of the Privacy Policy.

To serve you better, we may update the Privacy Policy based on the upgrading of our products and relevant requirements of laws and regulations. 4.Material changes in your rights and exercise of your rights to participate in the processing of your personal data;

5.Changes in our contact information and complaint channel for processing the security of personal data;

After receiving your comments and advices and verifying the user identity, we will respond to you in 30 days as soon as possible. Under normal circumstances, we will not charge you accordingly.However, please know and understand that we will not respond to your request under following circumstances:

1.opinion data kept solely for an evaluative purpose;

2.any examination conducted by an education institution, examination scripts and, prior to the release of examination results, examination results;

3.the personal data of the beneficiaries of a private trust kept solely for the purpose of administering the trust;

4.personal data kept by an arbitral institution or a mediation centre solely for the purposes of arbitration or mediation proceedings administered by the arbitral institution or mediation centre;

5.a document related to a prosecution if all proceedings related to the prosecution have not been completed;

(c) by a court, arbitral institution or mediation centre; or

(a) that would unreasonably interfere with the operations of the organisation because of the repetitious or systematic nature of the requests;

(b) if the burden or expense of providing access would be unreasonable to the organisation or disproportionate to the individual’s interests;

(c) for information that does not exist or cannot be found;

(d) for information that is trivial; or

(e) that is otherwise frivolous or vexatious.

If you are not satisfied with our response, or we infringe on your legitimate rights and interests in processing your personal data, and we refuse to make corrections even after receiving your feedback, you can file a complaint or report to the Personal Data Protection Commission or any other supervisory authorities.

IX. Miscellaneous

The Privacy Policy shall be governed and construed in compliance with the laws of the Republic of Singapore. Any dispute arising from or relating to the Privacy Policy shall be subject to the laws of the Republic of Singapore and resolved amicably between the parties through negotiation. If no agreement is made through negotiation, you agree to submit the dispute to a court of the Republic of Singapore which has jurisdiction over the dispute.
